Teen's Family Sues Aloha Jet Ski Rentals and Tourist Over Jet Ski Death

The family of a California teenager is suing an Australian man after his jet ski struck the jet ski that their daughter was roding on. Kristen Fonesca was on vacation in Hawaii on August 5 in Honolulu when her jet ski was struck by Tyler Dagley, age 20. He was charged with third-degree criminal homicide, and investigators say that he was driving recklessly while standing up in an attempt to show off for his girlfriend.

Kristen's parents were present at the time of the accident and watched as Tyler's speeding jet ski crashed into Kristen's jet ski. Kristen's head apparently lunged forward, hit the steering wheel, and she then fell forward and into the water. The lawsuit against Dagley accuses him of reckless and negligent operation of the jet ski and also names the jet ski rental company, Aloha Jet Ski Rentals, for failure to instruct Dagley on the proper use of the jet ski. The family also says that employees of Aloha Jet Ski Rentals did nothing to stop Dagley's reckless behavior in the water.

Although Kristen's family mentions severe emotional pain and suffering, as well as significant medical costs for Kristen's care, Dagley's father maintains that the whole ordeal was simply a tragic accident. Dagley's attorney also alleges that Dagley suffered permanent physical disfigurement from the accident and spent three nights and four days in the hospital. Kristin's parents say that the vacation in Hawaii was a reward for her good grades.
